Booking terms, cancellation policy, and travel guidelines

Introduction

Welcome to Marshmallow Safaris ("we," "our," or "us"). These Terms of Service govern your use of our website and safari travel services. By booking a safari or using our services, you agree to be bound by these terms.


Booking Terms & Deposits

To confirm your safari booking, the following payment terms apply:

  • A 30% non-refundable deposit is required at the time of booking to secure your reservation.
  • The remaining balance is due 30 days before the safari departure date.
  • Bookings made within 30 days of departure require full payment at the time of booking.
  • Failure to make payment by the due date may result in automatic cancellation of your booking.

Payment Methods

We accept the following payment methods:

  • Credit Cards: Visa, Mastercard, and American Express
  • Bank Transfers: Direct wire transfer to our Kenyan bank account
  • PayPal: For international clients preferring online payment

All prices are quoted in US Dollars (USD) unless otherwise stated. Bank transfer fees are the responsibility of the client.


Cancellation Policy

If you need to cancel your safari booking, the following refund schedule applies:

  • 60+ days before departure: Full refund minus $100 administrative fee
  • 30–59 days before departure: 50% refund of total safari cost
  • 15–29 days before departure: 25% refund of total safari cost
  • Less than 15 days before departure: No refund

No-show: Clients who fail to appear for their scheduled safari without prior notice will not be eligible for any refund.


Travel Insurance

Comprehensive travel insurance is mandatory for all travelers booking with Marshmallow Safaris. Your policy must cover:

  • Trip cancellation and interruption
  • Medical emergencies and hospitalization
  • Emergency evacuation and repatriation
  • Lost or delayed baggage

Note: All Marshmallow Safaris tours include complimentary AMREF Flying Doctors Evacuation Cover for emergency medical evacuation within East Africa.


Passport & Visa Requirements

It is the client's responsibility to ensure they have valid travel documents:

  • A valid passport with at least 6 months validity from the date of entry
  • Kenya requires an Electronic Travel Authorization (eTA) for most nationalities
  • Yellow fever vaccination certificate may be required depending on your country of origin
  • Clients are responsible for obtaining all necessary visas for multi-country itineraries

Health & Safety

Your safety is our top priority during all safari activities:

  • Malaria prophylaxis is strongly recommended for all safari destinations
  • Clients must follow all safety instructions provided by their safari guide
  • Wildlife encounters carry inherent risk — maintain safe distances at all times
  • Our guides are trained in first aid and carry emergency communication equipment

Changes to Itineraries

Marshmallow Safaris reserves the right to modify safari itineraries due to:

  • Weather conditions and road closures
  • Park regulations and wildlife management decisions
  • Safety concerns or security advisories
  • Overbooking at specific lodges or camps

Where possible, we will provide alternative arrangements of equal or higher standard at no additional cost.


Force Majeure

Marshmallow Safaris shall not be liable for any failure to perform its obligations due to circumstances beyond its reasonable control, including but not limited to:

  • Natural disasters (earthquakes, floods, volcanic eruptions)
  • Pandemics or health emergencies
  • Political instability, civil unrest, or terrorism
  • Government actions or travel restrictions
  • Labor strikes or transportation disruptions

In such cases, clients will receive a full refund or credit for future travel, at their choice.


Liability Limitations

Marshmallow Safaris acts in good faith to ensure safe and enjoyable safari experiences. However:

  • We are not liable for injury, loss, or damage except where caused by our proven negligence
  • Wildlife viewing involves inherent risks — we cannot guarantee specific animal sightings
  • We are not responsible for delays, cancellations, or changes caused by third-party service providers
  • Clients assume responsibility for their personal belongings during safari activities

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from these terms or our services shall be resolved exclusively in the courts of Nairobi, Kenya.
